Gujarat (Gujarat(High Court)High CourtFor the first time in history, a special Lok Adalat took up the matter.Lok AdalatYoji has become the first case to deal with a large number of cases simultaneously. With a positive attitude under the leadership of Chief Justice Arvind Kumar, the issues raised in the documentary process for the last few years have been resolved. A special Lok Adalat was organized for the retired professors of state government universities and colleges on the issue of pension. In which about 80 cases were disposed of simultaneously. Also, the biggest thing is that the applicants who have not come before the court, will also be given a quick pension in the coming days.
The pension process for retired professors has been stalled for the past seven years amid various questions and administrative dilemmas. But due to the positive attitude of Chief Justice of Gujarat High Court Justice Arvind Kumar, in addition to the professors who have passed eighty years, their heirs were given letters of provisional pension. An atmosphere of happiness was seen on the faces of the applicant pensioners.
RM Chhaya, executive chairman of the Gujarat High Court Legal Services Authority and senior judge of the high court, said that it was a moment of pride for him as well, as for the first time, more than 500 applicant pensioners had their questions resolved in this manner. The biggest thing is that in the Lok Adalat, Advocate General Kamal Trivedi, on behalf of the state government, stated that retired professors who have not appeared before the court will also be given a pension benefit expeditiously after completing the administrative process next week, which has been decided in principle. He also mentioned that arrears of Rs 500 crore and Rs 6-7 crore per month would be spent to pay pension benefits to the professors.
What is the functioning of Lok Adalat?
The Lok Adalat scheme is announced long before it is decided. The Bar Association also makes the necessary resolutions for this. With the consent of the parties as well as when the cases are placed in the Lok Adalat, the parties are informed of the matter by written notice. They are instructed to appear before the Lok Adalat on the date, time and place. When such parties appear in the Lok Adalat, their case is referred to the conciliation commission. These include advocates and village social workers. They try to resolve their disputes by persuading the parties and if the parties resolve the dispute, a written settlement is recorded accordingly. The case is disposed of in accordance with the law as ordered by the conciliatory judge, so that the parties do not incur the expense of traveling to court, bringing witnesses, as well as the cost of revision and the parties and witnesses do not have to return to court. Being there saves their time. If the case is settled with the consent of the parties then the previous relationship of the parties is restored and hence there is a possibility of future non-conflict between them. This results in a peaceful and cordial atmosphere between the family, the neighborhood, the community and the people of the village or town. The court fees paid in the cases decided in the Lok Adalat are refunded as per the provisions of the Act.
