
In view of the tough stance of US President Donald Trump and the turbulent atmosphere in the Middle East, the Indian government has issued an official advisory to all Indian citizens living in Iran to leave the country immediately. In this serious situation, there are many questions in the mind of the Indian workers working in the companies there.
Embassy Warning: This is not advice only!
The advisory issued by the Indian Embassy in Tehran is an official diplomatic warning. After this warning, if a company or employer keeps an Indian employee against his will, it is a direct violation of human rights.
Can the company fire you?
- The safety of workers in times of crisis is a company's first duty, not profit.
- Force Majeure: War or international sanctions can be considered “force majeure” (unforced circumstances) to suspend employment, but not immediate dismissal.
- Most of the companies send the employee to a safe place by giving Paid or Unpaid Leave at this time.
Owner's Legal Obligations and Indian Law
There are several legal provisions to provide protection to Indian workers
- Constitution of India (Article 21): Everyone has the right to life and personal liberty. No employer can stop a worker at risk of life.
- Emigration Act 1983: It is illegal to confiscate or force the passports of Indians working abroad.
- Indian Penal Code (IPC): The owner can be booked under Sections 340 (unlawful confinement), 503 (intimidation) and 506 (intimidation).
Protection of international laws
- Vienna Convention: An embassy has full authority to expel its nationals, with no interference by the local host.
- ILO (International Labor Organization): Prioritizing the safety of workers during a crisis is imperative.
What if the owner stops?
Remember, the owner cannot keep your passport or prevent you from taking the flight. If this happens immediately,
- Contact the Indian Embassy.
- Inform the Indian Ministry of External Affairs (MEA).
- Seek help from local police or international aid organizations.
Concerns about salary and future job
Normally the job is not canceled in such a situation. Workers can rejoin after the situation improves. Many reputable companies send employees back to their home countries only after paying wages.
Special instructions for workers
- Register at the embassy.
- Keep digital copy of passport and documents in phone.
- Inform the owner in writing (by email) about the return home.
