The Delhi High Court has directed the customs department not to seize the old and personal jewelry of tourists coming to India and not harass them. The court said that passengers should not have unnecessary problems at the airport. The order was issued following the harassment and seizure of jewelry worn during the journey.
The bench of Justice Pratibha M Singh and Rajneesh Kumar Gupta gave clear instructions to customs officials not to misbehave with Indian passengers and foreign tourists. The court gave the decision when the customs department said that the Central Board of Indirect Taxes and Customs (CBIC) is still working on a change in the rules and for this they need a little more time.
The decision came during the hearing of more than 30 petitions in which passengers complained to the customs for seizing their luggage and jewelry. Applicants said that customs officials seize jewelry for no concrete reason and harass passengers.
The court instructed the customs officials to strictly comply with the order. The court said that if the rules are not changed till the next hearing, the Standard Operating Procedure (SOP) should be created by May 19. This will be implemented till new rules come.
The Customs Department said that CBIC is discussing the matter with Stakeholders and busy making new rules. However, the court made it clear that customs officers will not be able to seize or use jewelry worn by passengers unless new rules are made.
After this decision, the passengers will get great relief. Especially people who come from abroad wear their own personal jewelry. They will no longer be unnecessarily stopped. The court has also decided that a temporary guideline should be made to ensure that passengers do not face problems if the rules are not changed by May 19.
