After Paldi in Ahmedabad, now the case of alleged violation of Disturbed Areas Act has heated up in Khanpur area. The dispute has now reached the doorstep of the Gujarat High Court, with allegations that a Hindu petitioner was wrongly used to get permission for unrest in an under-construction site called 'Bagban' in Khanpur.
What is the 'Bagbaan' site partnership dispute?
Checking the details of the partnership in the Bagban site revealed some shocking details. Adil Khan Pathan had 90% and Mujib Khan Pathan 5% share in the project, while a Hindu man named Jaimin Bharwad was made a partner with only 5% share. It is alleged that Jaimin Bharwad was brought forward as an applicant only to get approval for the project in the Hindu area. Surprisingly, Jamin Bharwad was removed from the partnership as soon as the agitation was approved.
MLA Kaushik Jain's Complaint and Investigation The matter came to the attention of local MLA Kaushik Jain who lodged a written complaint with the Chief Minister's Office (CMO) and the Collector. They allege that Muslim builders are flouting the law by presenting Hindu persons as 'Mahoras' to get approval for property transfer or construction in Hindu areas.
AMC's action and High Court's order for the construction was earlier obtained in the name of Sanjay Sheth and Rahbar Developers. However, the site was sealed in September 2024 by the Ahmedabad Municipal Corporation (AMC) after an investigation found irregularities and violations of rules. Even after paying the fine and opening the seal, the system has resealed the site due to repeated complaints. Against this action, the builder group has approached the High Court, where the High Court has ordered to maintain the 'Status Quo' at the site for the time being.
The incident has once again sparked a debate on the implementation of the Ashantdhara in the city and loopholes in it.
