The court said in its order that the company would have to pay damages if it did not act in the accident. In one such case, the court asked car maker Hyundai to pay a fine of Rs 3 lakh to Shailendra Bhatnagar for the damage caused in the accident. The accident happened in 2017. Shailendra Bhatnagar bought Hyundai’s Creta car in August 2015. His car was involved in an accident in November 2017. Bhatnagar had filed a petition in the Consumer Forum saying that he had bought the car keeping in mind the safety features of Creta. However, the airbag was not working during the accident, which caused him serious injuries.
The matter reached the Supreme Court following an order from the Consumer Forum. The case was heard by a bench of Justice Vineet Saran and Justice Aniruddha Bose. The bench also ordered the car company to change the vehicle. A lawyer representing the company said the airbags do not work unless there is an obstruction from the front. The court ruled that the consumer and consumer are not physicists who can calculate speed and strength at the time of an accident. The Consumer Forum had earlier ruled in favor of Bhatnagar, which was challenged by Hyundai in the Supreme Court.
